Flags in American Fashion: A Short History

·

A man in Massachusetts was arrested in 1970 and sentenced to six months in jail for wearing a small flag on the seat of his jeans. Today you can buy a flag shirt in any supermarket in the country. The distance between those two facts is about fifteen years and three Supreme Court cases, and it explains why flag clothing still makes some people uneasy.

Flag apparel did not drift into American wardrobes quietly. It arrived as provocation, was prosecuted as desecration, and only became ordinary after the courts decided it had to be allowed.

The jacket that started the argument

The image most people carry is Peter Fonda in Easy Rider in 1969, riding a chopper in a leather jacket with the flag across the back. The character was called Captain America and the jacket was not subtle about it.

What is easy to miss now is how aggressive that read at the time. A flag on a motorcycle jacket in 1969 was not a patriotic gesture, it was an argument about who the flag belonged to. Fonda wore the jacket for years afterwards until it fell apart, then cut the flag patch off and had it framed. It later sold at auction for just under ninety thousand dollars.

Six months in jail for a patch on a pocket

Valarie Goguen was arrested in Leominster, Massachusetts, for wearing a cloth flag roughly four inches by six sewn onto the seat of his blue jeans. A Worcester County jury convicted him and the judge handed down six months.

The case reached the Supreme Court as Smith v. Goguen in 1974. The Court let the reversal stand, though on narrower ground than people often assume. It turned on vagueness rather than free speech: the statute punished anyone who treated the flag contemptuously, and that was too vague to tell a citizen what was actually forbidden. Justice Powell noted that attitudes toward the flag had changed dramatically, and that it could hardly have been the legislature’s purpose to make criminal every informal use of the flag.

Three months later the Court decided Spence v. Washington. Harold Spence, a college student in Seattle, had hung a flag upside down in his apartment window with a peace symbol taped onto it, protesting Cambodia and the killings at Kent State. His conviction was reversed as an impermissible infringement of protected expression.

Two cases, three months apart, both about a flag on private property or a private body, both resolved against the state.

The case everybody actually quotes

The settled position arrived in 1989 with Texas v. Johnson, which held that burning the flag as political protest is protected speech. That decision is the reason the Flag Code’s line about the flag never being used as wearing apparel has no teeth. It is guidance with no penalty attached.

We covered what that means in practice in can you wear the American flag, which is the short version for anyone who just wants to know whether they are allowed.

How it became ordinary

Once the legal question was closed, the cultural one resolved quickly. Flag motifs moved from protest into Americana, then into workwear revival, then into the normal stock of every apparel brand in the country. The same design that would have drawn a prosecution in 1970 now turns up on a toddler’s romper.

Something was lost in that, and it is worth naming. When everything carries a flag, the flag stops saying anything in particular. A design has to work a little harder now to mean something rather than simply signal a season.

What this leaves for a designer

The useful lesson from that history is that the strongest flag clothing has never been a literal reproduction of the flag. Fonda’s jacket was a flag used as an image. The designs that still read well are the ones that take an element, the field of stars, the stripe geometry, a single color relationship, and build something with it.

That is the thinking behind our Flag Classics range. It also avoids the practical problem that a printed rectangle of flag on a chest reproduces badly on fabric and ages worse.

If you want the background on the flag itself rather than its clothing, we wrote about what the stars and stripes actually mean, including the fact that nobody in 1777 wrote down what the colors stood for.

Was it ever illegal to wear the American flag? It was prosecuted. States had flag desecration statutes, and Valarie Goguen was arrested in 1970 and sentenced to six months for a flag patch on his jeans. The Supreme Court struck that conviction down in 1974 on vagueness grounds.

Is flag clothing legal now? Yes. Since Texas v. Johnson in 1989 the Supreme Court has treated flag expression as protected speech. The Flag Code discourages flag apparel but carries no penalty.

What was the Easy Rider jacket? The leather jacket with an American flag across the back worn by Peter Fonda as Captain America in the 1969 film. Fonda later removed the worn flag patch and framed it, and it sold at auction for close to ninety thousand dollars.

Why does flag clothing still bother some people? Because within living memory it was a protest gesture rather than a patriotic one, and for a while it carried criminal risk. That association has faded but has not entirely gone.

Does the Flag Code ban wearing the flag? It says the flag should never be used as wearing apparel, but the Code is advisory for civilians and includes no enforcement provision.
